TERMS
Last updated: October 22, 2026
These Terms of Service ("Terms") govern all orders placed and contracts concluded through calabas.co (the "Site"). Please read them carefully before placing an order.
1. Provider / Seller
The Site and store are operated by:
Calabas LLC, a limited liability company organized in Wyoming, USACurrently operating from:
An der Horeburg 21
21079 Hamburg, Germany
Email: support@calabas.co
Phone: +49 151 54962626
In these Terms, "we", "us", "our", or "Calabas" refers to Calabas LLC; "you" refers to the customer. Full provider identification is set out in our Imprint.
2. Scope & Definitions
2.1 These Terms apply to all orders placed via the Site by both consumers and businesses. Any conflicting terms of the customer do not apply unless we have agreed to them in writing.
2.2 A consumer is any individual who enters into the contract for purposes that are predominantly outside their trade, business, or profession. A business/entrepreneur acts in the course of their trade or profession. Certain provisions below (in particular the right of withdrawal and statutory warranty) apply to consumers only.
2.3 The version of these Terms in force at the time of the order applies.
3. How a Contract Is Formed
3.1 The presentation of products on the Site is not a binding offer but an invitation to place an order.
3.2 By clicking the "Pay now" button at the end of the checkout, you make a binding offer to purchase the items in your cart.
3.3 We may accept your offer by sending an order confirmation by email or by dispatching the goods. An automatic acknowledgment of receipt of your order does not by itself constitute acceptance. A contract is formed only upon our acceptance.
3.4 Before submitting your order you can review and correct your entries at any time using the usual browser and checkout functions (e.g. "back" button, edit cart).
4. Contract Language & Storage
The contract is concluded in English. We store the contract text and send you the order details by email. The current Terms can be viewed and saved on this page at any time.
5. Prices & Shipping Costs
5.1 Prices are displayed in your local currency where we support it. The currency your order is charged in is shown at checkout before you pay, and the price valid at the time of the order applies. Where a price is converted, the conversion rate is the one applied by our payment provider at that moment.
5.2 For customers in the EU, the prices shown are final prices. Any shipping costs are shown separately before you submit your order.
5.3 For customers in the US, prices are shown excluding sales tax where applicable; any sales/use tax and shipping are calculated and displayed at checkout based on your delivery address.
5.4 Applicable shipping costs are displayed in the cart and at checkout before you place your order.
6. Payment
6.1 We offer the following payment methods, as shown at checkout: Shopify Payments (incl. Shop Pay, Apple Pay, Google Pay), PayPal, and Klarna. We reserve the right to offer only certain payment methods for a given order.
6.2 Payment is generally due immediately upon conclusion of the contract, unless a selected method (e.g. Klarna invoice/instalment) provides otherwise. Where you choose a third-party payment service, that provider's terms also apply.
6.3 Payment data is processed by our payment providers; we do not receive or store your full card details. See our Privacy Policy for details.
7. Delivery
7.1 We ship worldwide, except to destinations where delivery is prevented by law, trade sanctions, or carrier restrictions. The destinations we can currently deliver to are the ones offered at checkout.
7.2 We dispatch orders within 1 to 3 business days of your order confirmation. Delivery is carried out by UPS, FedEx, USPS, DHL, or Deutsche Post (or another carrier we select); transit time after dispatch depends on the destination and the carrier and is shown at checkout. Stated dispatch and delivery times are estimates and not guaranteed dates unless expressly agreed.
7.3 If we are unable to deliver because items are unavailable through no fault of our own, we will inform you promptly and refund any payments already made without undue delay.
7.4 Passing of risk. For consumers, the risk of accidental loss or damage passes to you when the goods are delivered to you (or to a carrier you designated who was not offered by us). For businesses, risk passes upon handover to the carrier.
8. Retention of Title
The delivered goods remain our property until full payment has been received.
9. Right of Withdrawal for Consumers (EU/EEA)
If you are a consumer with habitual residence in the EU/EEA, you have a statutory right to withdraw from the contract as set out below.
Declare a withdrawal One form, and it is on record. A plain email works exactly the same.
Withdrawal Instructions
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods (or, in the case of multiple goods in one order delivered separately, the last good).
To exercise the right of withdrawal, you must inform us
Calabas LLC, An der Horeburg 21, 21079 Hamburg, GermanyEmail: support@calabas.co
of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

10. Returns & Refunds (general)
10.1 Beyond the statutory right of withdrawal above, we accept returns within 14 days of delivery for items that are unworn, unwashed, and in their original condition with all tags attached.
10.2 Refunds are issued to the original payment method after we receive and inspect the returned item.
10.3 This voluntary policy does not limit or replace the statutory right of withdrawal (Section 9) or statutory warranty rights (Section 11) for consumers.
11. Statutory Warranty & Defects
11.1 For consumers in the EU/EEA, the statutory warranty (conformity of goods) applies, generally for two (2) years from delivery. If goods are defective, you are entitled to the statutory remedies (repair, replacement, price reduction, or withdrawal) in accordance with applicable law.
11.2 For business customers, the statutory warranty period is shortened to twelve (12) months from delivery, the shortest period permitted in standard terms, and you must inspect the goods and notify obvious defects without undue delay. This shortening does not apply to claims for injury to life, body, or health, to damage caused intentionally or by gross negligence, to fraudulently concealed defects, or where we have given a guarantee.
11.3 For US customers, we give no express warranty beyond what is described at the point of sale. If an item reaches you faulty, damaged, or not as described, contact us and we will repair, replace, or refund it. Nothing in these Terms excludes or limits any warranty or right that applicable state law does not permit to be excluded or limited.
11.4 To make a warranty claim, contact support@calabas.co.
12. Limitation of Liability
12.1 We are liable without limitation for damages arising from injury to life, body, or health, for intent and gross negligence, and under mandatory law (e.g. product liability).
12.2 For slight negligence, we are liable only for breach of a material contractual obligation (an obligation whose fulfillment is essential to the proper performance of the contract and on which you may rely), and then only for foreseeable, contract-typical damage.
12.3 Any further liability is excluded to the extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory consumer law.
13. Dispute Resolution
13.1 The European Commission's Online Dispute Resolution (ODR) platform ceased operations on July 20, 2025, and the previous obligation to link to it no longer applies. Please contact us first at support@calabas.co, we aim to resolve complaints directly.
13.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). This disclosure is required under the German VSBG.
14. Governing Law & Jurisdiction
14.1 These Terms and any contract are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 For consumers, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence, and you may bring proceedings in the courts of your country of residence where mandatory law so provides.
15. Final Provisions
15.1 If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected.
15.2 We may amend these Terms with effect for the future; the version in force at the time of your order applies to that order.
